When you think of distracted driving, you probably think about being on your phone. However, numerous accidents are caused each year by a number of other factors as well. 

Distracted Driving Laws In Ontario

Penalties for distracted driving depend on the kind of license and driving experience, but no matter what, holding a phone or other device while driving is against the law.

What Is Permitted

You are permitted to view and use hands-free wireless devices like GPS displays on the dashboard or a securely mounted device. 

If You Are Injured In a Distracted Driving Accident

If an accident occurs due to one driver being distracted or driving carelessly, the injured party will be able to apply for Accident Benefits through their insurance provider. These benefits can cover things like medical expenses, income replacement, and other expenses. These benefits are available regardless of who is at fault for the accident.

On the other hand, tort claims are legal actions brought against the at-fault party to recover damages, such as pain and suffering, loss of income, and other losses. Tort claims require proof of fault or negligence on the part of the at-fault party and the compensation is typically higher than Accident Benefits.
