Title Search

Whether buying, selling, or refinancing, any qualified real estate lawyer will first conduct a real estate title search of the property. The importance of this first step is to verify the current registered owners, confirm the legal description and property identifier number (PIN), to confirm there are no easements, bylaws or liens registered against the property. This will also reveal if there are any writ of executions against the registered owner.

Land Transfer Tax

You are required to pay provincial land transfer tax when you buy land. It is also important to note that when buying in Toronto, you will be required to pay both the provincial and municipal land transfer tax. However, if you are a first-time home buyer, you may be eligible for a refund of part or all the land transfer tax.

Condominium Status Certificates

Before you purchase a condominium unit, it is important to have your realtor obtain the status certificate of the condominium corporation and have your real estate lawyer review it. The status certificate provides a financial snapshot of the condominium corporation. This includes evaluating if the current owner is in default of the common expenses, if the corporation has valid insurance coverage, and if the corporation is involved in any legal proceedings, as well as much more.

Title Insurance

Title insurance is a policy that protects registered owners and their lenders against title-related issues and losses. While title insurance is optional in Ontario, it is highly recommended by lawyers. Also, it is also often a requirement for financial institutions when lending money.
