As Ontario lawyers helping individuals access Canada Pension Plan Disability (CPPD) benefits, we understand the eligibility criteria and the qualification process for our clients.

CPPD benefits provide financial support to those who are unable to work due to a severe and prolonged disability.

Here is how you qualify:

  1. Minimum Contributions to CPP: To be eligible for CPPD benefits, an applicant must have made contributions to the Canada Pension Plan in four of the last six years, with minimum levels of earnings in each of these years, or three of the last six years for those with 25 or more years of contributions.
  2. Severe and Prolonged Disability: The physical or mental disability must be both severe and prolonged. Severe means that the disability must prevent the applicant from doing any substantially gainful work. Prolonged means that the disability is long-term and of indefinite duration or is likely to result in death.
  3. Medical Documentation: The applicant is only responsible for sufficiently filling out the CPPD application to their best ability and provide as much information as possible to assist Service Canada in obtaining medical documentation directly from sources. This should include detailed reports from healthcare professionals outlining the nature and extent of the disability and how it affects the ability to work.
  4. Application Process: We help our clients with the application process. This involves completing the necessary forms, gathering medical evidence, and submitting the application to Service Canada. Ensuring accuracy and completeness is vital to avoid unnecessary delays or denials.
  5. Reconsideration and Appeals: If your application is denied, we can assist with the appeals process. It is important to note that applicants are given 90 days from the date of the CPPD decision to file an application for Reconsideration with Service Canada. If the application for Reconsideration is denied, then the applicant will need to file a first level appeal with the Social Security Tribunal. Read more about the appeals process in our article How to Appeal if Your CPP Disability Claim was Denied.

Navigating the CPPD application process can be complex, so the support and expertise of a lawyer in Ontario can be invaluable. We guide our clients through the eligibility requirements but also ensure that their application is compelling and well-documented. By understanding the key criteria and offering legal assistance, we can help you access the financial support you need during a challenging period in your life.
